MEMBERSHIP POLICY
MEMBERSHIP CONTRACT: All persons becoming a member of CocoonCare will sign
a Membership Contract. Each member will be subject to the terms of
the contract, and the terms of the contract are incorporated herein by
reference.
PRESCREENING & PHYSICIAN’S APPROVAL: Each person taking classes at
CocoonCare or using equipment provided by CocoonCare will be subject to a
prescreening questionnaire, and will provide CocoonCare with a physician’s
approval of their ability to engage in activities offered by CocoonCare.
PARTICPATION IN COCOONCARE SERVICES: Each member is responsible for
conveying her exercise restrictions to instructors of fitness classes. You are
responsible for making sure that your healthcare provider is aware, and
approves, of your participation in CocoonCare services.
CLASSES: Instructors teaching fitness classes at CocoonCare are
independent contractors, and are not employees of, or involved in a joint
venture with, CocoonCare. All pre-natal and post-natal expertise is
provided by the instructors, and CocoonCare relies on the pre-natal/post-natal
expertise of the instructors.
EQUIPMENT: CocoonCare has not manufactured the equipment available to its
members. CocoonCare takes precautions to maintain the equipment, but
CocoonCare is not responsible for injuries or accidents resulting from members’
use of the equipment.
CANCELLATION OF MEMBERSHIP CONTRACT: Member can cancel her membership
contract at any time with an e-mail, written notice or phone call. Refunds are at the discretion of CocoonCare:
REFUND/CANCELLATION OF CLASS PASSES: Please refer to our
Class Pass Policy.
CONSENT & RELEASE: MEMBER, ON BEHALF OF MEMBER, MEMBER’S HEIRS, SUCCESSOR
AND ASSIGNS, HEREBY RELEASES COCOONCARE, ITS OWNERS, AFFILIATES, SUBSIDIARIES,
SUCCESSORS, ASSIGNS, EMPLOYEES, MEMBERS, MANAGERS, DIRECTORS, OFFICERS, AND/OR
AGENTS (PAST, PRESENT, AND FUTURE) FROM ANY LIABILITY, CLAIMS, DEMANDS AND
CAUSES OF ACTION RESULTING FROM MEMBER’S PARTICIPATION IN CLASSES HOSTED BY
COCOONCARE, OR USE OF EQUIPMENT PROVIDED BY COCOONCARE OR COCOONCARE’S FACILITY.
RULES AND REGULATIONS: All members must obey the rules and regulations
posted at the facility. CocoonCare reserves the right to amend, modify,
add or remove any and all rules or regulations, at any time.
MEMBER REQUIREMENTS: Without limitation, Members must:
a.
Always consider other members' rights and privileges while training;
b.
Always pay membership dues;
c.
Always carefully handle equipment provided by CocoonCare;
d.
Never put feet on the wall;
e.
Never drop dumbbells or barbells on the floor or bang them together;
f.
Always dispose of trash in the proper places;
g.
Always treat members and staff with fullest respect and courtesy at all
times;
h.
Always accept fullest responsibility for any damage done to equipment due
to Member’s misuse of the equipment;
i.
Always report faulty equipment and discontinue use of the same;
NON-TRANSFERABLE/NON-ASSIGNABLE: Memberships are not assignable or
transferable, and must be used by the person purchasing the memberships.
INSTRUCTORS & WORKSHOP ADMINISTRATORS: Instructors and workshop
administrators are all independent contractors and are not employees of
CocoonCare. CocoonCare does not have a joint venture with said instructors
or workshop administrators. COCOONCARE IS NOT LIABLE FOR THE WILLFUL
MISCONDUCT, OMISSIONS OR NEGLIGENCE OF SAID INSTRUCTORS OR WORKSHOP
ADMINISTRATORS.
GENERAL: You do not have to be a member of CocoonCare to take a class.
